خیبرپختونخوا اسمبلی سیکریٹریٹ میں آئینی ماہرین کا اہم اجلاس ہوا، جس میں مستعفی وزیراعلیٰ علی امین گنڈاپور کے خلاف تحریک عدم اعتماد کے آپشن پر تفصیلی غور کیا گیا۔

اجلاس میں آئینی ماہرین نے واضح کیا کہ چونکہ علی امین گنڈاپور اپنا استعفیٰ دے چکے ہیں، اس لیے ان کے خلاف تحریکِ عدم اعتماد لانے کی آئینی گنجائش موجود نہیں۔ اسمبلی سیکریٹریٹ نے بھی اس مؤقف کی تائید کرتے ہوئے کہا کہ وزیراعلیٰ کے مستعفی ہونے کے بعد عدم اعتماد کا عمل غیر مؤثر قرار پاتا ہے۔
ذرائع کے مطابق، عدم اعتماد کی تحریک کو عدالت میں چیلنج کرنے کا آپشن زیرِ غور ہے۔ تاہم پاکستان تحریک انصاف (پی ٹی آئی) نے آئینی ماہرین اور اسمبلی سیکریٹریٹ کی سفارشات کی روشنی میں فی الحال تحریک عدم اعتماد کا فیصلہ مؤخر کردیا ہے۔
واضح رہے کہ گورنر خیبرپختونخوا فیصل کریم کنڈی کی جانب سے علی امین گنڈاپور کا استعفیٰ منظور نہ کیے جانے کے بعد پی ٹی آئی نے انہیں اسمبلی میں تحریکِ عدم اعتماد کے ذریعے ہٹانے کا فیصلہ کیا تھا، اور اس مقصد کے لیے آج سہ پہر 3 بجے اسمبلی اجلاس طلب کیا گیا تھا۔
یاد رہے کہ علی امین گنڈاپور نے چند روز قبل وزارتِ اعلیٰ سے استعفیٰ دیا تھا، جب کہ پی ٹی آئی نے ان کی جگہ سہیل آفریدی کو نیا وزیراعلیٰ نامزد کیا تھا۔ تاہم گورنر نے مؤقف اختیار کیا کہ انہیں ابھی تک استعفیٰ باضابطہ طور پر موصول نہیں ہوا۔
